Terms of Service
Last updated: October 20, 2026
These terms apply when a medical spa, dental practice or other clinic ("you", "the clinic") uses services from ClinicEcho ("we", "us"), operated by Himanshu Yadav. By starting a free trial, signing an order form or paying an invoice, you agree to these terms. If an order form you signed says something different, the order form wins.
1. What we provide
ClinicEcho sets up and runs an AI receptionist for your clinic. Depending on your plan, this can include answering calls and website chat, booking appointments into a calendar, emailing your team a summary of each conversation, review-request and win-back emails, a clinic dashboard, and (on ClinicEcho Growth) managing patient ads and building a clinic website. Your order form lists exactly what's included for you.
2. Free trial
A free trial runs for 14 days unless we agree otherwise in writing. There's no charge and no card is needed. At the end of the trial, the service is switched off unless you sign up for a paid plan. You can end a trial at any time by emailing us.
3. Fees and payment
- Fees are shown on your order form or invoice, in US dollars.
- Monthly fees are billed in advance at the start of each billing month. Any one-time setup fee is billed when you sign up, unless it's waived.
- If your plan includes a set number of AI minutes, extra minutes are billed at the rate on your order form at the end of the month.
- For ClinicEcho Growth, your advertising budget is paid by you directly to the ad platforms (for example, Google and Meta). It is separate from our fees.
- Invoices are due within 7 days. If a payment is more than 15 days late, we may pause the service until it's paid, after giving you notice by email.
- You're responsible for any taxes that apply in your location, other than taxes on our income.
4. Term and cancellation
Paid plans have a 3-month minimum term, then continue month to month. After the minimum term, you can cancel at any time by emailing hello@clinicecho.com. Cancellation takes effect at the end of the billing month you've already paid for. See our Refund and Cancellation Policy for details.
5. Your responsibilities
- Give us accurate information about your clinic, including services, approved prices, hours, insurance accepted and booking rules, and tell us when it changes.
- Set up call forwarding on your phone system and keep your booking calendar up to date.
- Follow the laws that apply to you, including laws on call recording, patient consent and marketing messages. Our receptionist announces that calls may be recorded, but you're responsible for confirming this meets the rules in your state.
- Review the summaries we send you and follow up with patients as needed.
6. How the AI receptionist works, and its limits
- The receptionist tells callers it is an AI assistant. It does not give medical advice or diagnose, and it passes clinical questions to your team.
- It is not an emergency service. It follows the emergency instructions you give us (for example, telling callers to call 911) but does not replace them.
- Like any AI, it can occasionally misunderstand a caller or make a mistake. We test it with you before it goes live and fix issues you report promptly.
- We don't guarantee a specific number of calls answered, bookings, patients, reviews or ad results.
- The service depends on third-party providers (such as phone carriers, AI and hosting providers). We're not responsible for outages caused by them, but we'll work to restore service quickly.
7. Patient information and privacy
Before we handle any protected health information for your clinic, we sign a Business Associate Agreement (BAA) with you. We use patient information only to provide the service to you and as the BAA allows. Our Privacy Policy explains how we handle other information.
8. Ownership
Your clinic's data, including call records, transcripts and patient details, belongs to you. When you leave, we'll give you an export on request and then delete it as described in our Refund and Cancellation Policy, unless the law requires us to keep it. We own the ClinicEcho software, prompts, templates and know-how we use to provide the service. Any clinic website we build for you on ClinicEcho Growth is yours to keep once all fees for it are paid.
9. Limitation of liability
To the extent the law allows, our total liability for any claim relating to the service is limited to the fees you paid us in the 3 months before the claim. We're not liable for indirect losses, such as lost profits or lost patients.
10. Changes to these terms
We may update these terms. If we make a change that affects paying clinics, we'll email you at least 30 days before it applies. The date at the top shows when the terms last changed.
11. Governing law
These terms are governed by the laws of India, and the courts of New Delhi, India have jurisdiction, unless your order form says otherwise.
